Abstract:  The business environment of corporate America is

changing rapidly and has necessitated a change in accounting

education to keep pace with the needs of the business world.  The

purpose of this study is to discuss the proposed changes in

accounting education, provide an overview of the use of teams in

the workplace, introduce THE GAME, a structured and collaborative

exercise designed to increase student participation in the learning

process, and develop some short activities that students work on

collaboratively.  These exercises contribute to active learning,

critical thinking, problem solving, and interpersonal skills, which

are attributes critical for success in the accounting profession.

Mel E. Schnake & S. Andrew Ostapski, A Serendipitous Active

Learning Experiment in Labor Relations and Collective Bargaining,

3 J. of Acad. of Bus. Ed. 18 (2002).

Abstract:  One month into a Labor Relations and Collective

Bargaining course, a tongue-in-check request by a student to

negotiate for a curve on the first examination led to a worthwhile

active learning experience.  Students created a negotiations team

and negotiated with the instructor for a new "collective bargaining

agreement," which replaced the course syllabus.  The negotiations

provided the students an opportunity to experience negotiations

which had the potential to actually affect them personally, as well

as an opportunity to experience many aspects of "real world"

negotiations.

Sexual Harassment Survey:  Exploring Gender Differences, The 2000

Annual, Volume 1, at 135 (Elaine Biech ed., Jossey-Bass/Pfeiffer

Inc. 2000).

Abstract:  Much confusion exists in organizations about what

constitutes sexual harassment.  The legal definition evolves with

every case that is decided by the U.S. Supreme Court.  Many

organizations either overreact or underreact to reports of sexual

harassment.  Individuals wonder whether they are behaving properly.

Recent research indicates that males and females view sexual

harassment in very different ways.  The Sexual Harassment Survey

(SHS) explores the different perceptions of men and women in order

to educate both about their differences and their responsibilities

under the law.  The SHS is designed to be administered in group

learning situations.  After completing the survey, individuals

score their results, and group participants discuss their feelings,

strengthen their knowledge of the law, and learn appropriate

behaviors.  Some research findings and case law developments are

offered so that participants can compare their perceptions to other

groups and to the latest legal interpretations.

     S. A. Ostapski & Don Seat, Shareholders' Preemptive Rights: An

Inconsistent Jurisdictional Approach, State-to-State, Fall 1999, at

Abstract:  Multi-jurisdictional legal practice can be the source of

much satisfaction or a trap for the unwary.  States' public policy

can vary widely in the protection of a shareholder's percentage of

ownership.  Ultimately, shareholders are best protected if

preemptive rights are explicitly included within the articles of

incorporation.

     S. Andrew Ostapski & Peter M. Bergevin, The Internet:

Critical Thinking and Ethical Restraints, Ethics & Critical

Thinking J., Jun. 1997, Sect. 4, at 1.

Abstract:  Boundless communication is both the ultimate gift and

the ultimate curse that the Internet offers.  The electronic

disseminator of global information cannot only unlock the Library

of Congress but also satisfy humankind's most prurient interests.

When technological means are created and if legislation is enacted,

regulation of this medium may stifle creativity.  This paper argues

that Internet freedom should be protected as it evolves to protect

its utilitarian features.  Education, not regulation, of the

information seekers and information providers offers the best long-

term solution for responsible usage of this revolutionary method of

communication.

and Economic Implications of Smoking in Enclosed Public Facili-

ties:  A Resolution of Conflicting Rights, 16 J. Bus. Ethics 377

(1997).

Abstract:  Smokers and nonsmokers possess equal rights but those

rights conflict with each other in the use of shared facilities.

Medical research has established that smoking harms not only those

who use the product but also those who are passively exposed to it.

Laws and private regulation of smoking in shared facilities have

resulted in the segregation of smokers from nonsmokers to an

outright ban of tobacco use.  Such controls have provided

unsatisfactory results to both groups.  An acceptable ethical

solution, based on reduction of harm and compensation, can be

derived by applying Moral Audit principles, supported by economic

analysis, which does not unduly curtail the rights of both parties

as to the use of tobacco products.

Place at Public College and University Official Functions?, 5 J. of

Abstract:  The issue of prayer in the educational system has gained

prominence as the public mourns the perceived decline of society's

moral fiber.  Traditionally, the aim of education has been to

prepare students for their future roles in shaping society.  The

limited inclusion of prayer may have surfaced as a means to give

students exposure to moral values at institutions of learning,

which lack specific moral direction.

life forms, the physical world, and nature in general.  Treaties

among nations, constitutions, local and federal statutes, judicial

Abstract:  The debate on whether and how to teach business ethics

in graduate business programs continues.  The authors of this

article suggest specific content and processes for a course aimed

at giving MBA candidates the awareness, tools and mental processes

necessary to recognize and address ethical issues in decision

making.  The inclusion of labor law, discrimination issues,

consumer protection legislation, securities laws, and an overview

of the U.S. Constitution and the Bill of Rights coupled with the

development of utilitarian, deontological, and egalitarian analysis

of ethical issues provides the tools and processes necessary for

ethical decision making.  These tools and processes are applied in

several class experiences using cases, moral audits, and the

development of a code of ethics to help students acquire the

knowledge, skills, and values needed in ethical decision making.

Regulation in Shared Facilities:  An Ethical and Economic Analysis

Abstract:  Smokers and nonsmokers possess equal rights but those

rights conflict with each other in the use of shared facilities.

Medical research has established that smoking harms not only those

who use the product but also those who are passively exposed to it.

These findings, along with the annoyance generated by passive

smoke, have provided considerable support to the recent trend

toward laws and private regulations that ban or restrict smoking in

public places.

Abstract:  The role of the military is essential for the safeguard

of liberty in society.  Regrettably, the military has suffered

unwarranted criticism and severe budget cuts.  This article

reaffirms the concept that the price for liberty must be paid to

insure our cherished way of life.

Abstract:  Admittedly, a Code of Ethics and Moral Audit cannot make

employees intrinsically moral.  However, these mechanisms do

enforce the value system of the organization by providing a

collective sense of right and wrong against which specific issues

can be systematically assessed.

Responsibility and the Moral Audit:  Domestic and International

Implications for Refuse Relief, Inc., (Center for International

Business Education and Research Discussion Paper Series 92-2,

University of Miami, Coral Gables, Florida 1992).

Abstract:  Attributing morality to a corporation may seem somewhat

inappropriate because it is merely an artificial entity.  Yet, a

corporation is only as ethical as its agents.  At a minimum, Refuse

Relief Inc. must meet legal requirements, but the development of

moral responsibility requires a conscious effort by all corporate

agents to avoid harming others whether at home or abroad.  This

concept, termed the International Imperative, obliges the

multinational company to benefit the society in which it exists.

Equity requires that the cost of any harm produced by its

operations must be shared by those entities, which are benefited,

in the same proportion as the benefit received.

     S. Andrew Ostapski & Camille N. Isaacs, Corporate Moral

Responsibility and the Moral Audit:  Challenges for Refuse Relief

Inc., 11 J. Bus. Ethics 161, 231 (1992).

Abstract:  Much debate has occurred as to whether or not moral

responsibility should be ascribed to corporate entities.  The

present study advances the theory that moral responsibility is a

self-imposed or attributable aspect of corporate operations which

extends beyond the parameters established by law.  In this context,

the corporation must consciously endeavor to discharge its moral

responsibility to avoid, minimize, eliminate and compensate for the

potential or actual harm which its operations cause.  To establish

this objective, consideration is given to the establishment of a

Moral Audit Committee, an internal monitoring mechanism, with a

proposed generic structure.  The corporate Mission Statement and

Code of Ethics play a vital role as well in building an

institutional environment which supports this self-appraisal

process.  With this system in place, the ambit of a Moral Audit is

then examined.  This study concludes with a case analysis which

partly depicts the Moral Audit process.
